1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the resume and CV building services (the "Service") provided by Nextvorlage (referred to as "Nextvorlage", "we", "us", or "our"), located in Berlin, Germany, through our website www.nextvorlage.com (the "Website") and any related applications.
By accessing or using our Website and Service, you signify your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Please read them carefully.
2. Use of the Service
Subject to your compliance with these Terms, Nextvorlage grants you a non-exclusive, non-transferable, revocable license to access and use the Service for the primary purpose of creating, editing, storing, and managing your resumes and Curriculum Vitae (CVs) for your personal, non-commercial, or professional job-seeking use.
You agree not to use the Service for any illegal or unauthorized purpose, or in any way that violates these Terms or any applicable local, state, national, or international laws and regulations.
3. User Accounts & Responsibilities
(a) Account Creation: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
(b) Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify Nextvorlage immediately of any unauthorized use of your account.
(c) User Content: You are solely responsible for all data, information, text, graphics, and other materials that you upload, post, transmit, or otherwise make available through the Service ("User Content"), including the accuracy, legality, and appropriateness of your User Content. You retain ownership of your User Content.
(d) Prohibited Conduct: You agree not to: i. Upload or transmit any material that is unlawful, harmful, defamatory, obscene, infringing, or otherwise objectionable. ii. Upload or transmit any viruses, malware, or other harmful code. iii. Attempt to interfere with, disrupt, or gain unauthorized access to the Service, its servers, or networks. iv. Use the Service in any manner that could damage, disable, overburden, or impair it.
4. Payments, Tokens, and Subscriptions
(a) Paid Services: Nextvorlage offers certain features and services that may require payment, either through one-time purchases of "Tokens" or via recurring "Subscription" plans. By selecting a paid service, you agree to pay Nextvorlage the fees indicated for that service.
(b) Tokens: Tokens may be purchased in packs and can be redeemed for specific actions, such as downloading a resume, as described at the point of purchase. Tokens are non-refundable and may have an expiration policy if stated at the time of purchase (if not stated, assume they do not expire).
(c) Subscriptions: Subscription plans provide access to specified features for a set period (e.g., monthly, semi-annually, annually). i. Billing: Subscription fees will be billed on a recurring basis as per the selected plan. You authorize us (or our third-party payment processor, like Stripe) to charge your chosen payment method for these recurring fees. ii. Cancellation: You can manage and cancel your subscription through your account settings or by contacting us. Cancellation will typically take effect at the end of the current billing period. iii. No Refunds: Subscription fees are generally non-refundable, except as required by law or as explicitly stated in any refund policy Nextvorlage may offer.
(d) Payment Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
(e) Price Changes: Nextvorlage reserves the right to change its prices for Tokens, Subscriptions, or any other services at any time. We will provide you with reasonable prior notice of any price changes to your existing subscriptions.
5. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Nextvorlage and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Nextvorlage.
You retain all ownership rights to the User Content you create and input into the Service.
6. Termination
(a) By Nextvorlage: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
(b) By You: You may terminate your account and stop using the Service at any time. Instructions for account deletion can be found in your account settings or by contacting support.
(c) Effect of Termination: Upon termination, your right to use the Service will immediately cease. If your account is terminated, we may, in our sole discretion, delete your account and User Content. Certain provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NEXTVORLAGE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NEXTVORLAGE DOES NOT WARRANT THAT (I) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (IV) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXTVORLAGE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, IN THE AGGREGATE, SHALL NOT EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNTS PAID BY YOU TO NEXTVORLAGE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by the competent courts located in Berlin, Germany.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Website and the Service.
